COUNCIL MINUTES OF TUESDAY – DECEMBER 23, 2003 – 7:30PM

Mayor Richard Huebler called the meeting to order at 7:31pm. Roll called showed present Councilwoman Tina Gaworecki, Councilman Gary Burtka (8:30pm), Councilman James Grose, Councilman Eric Waidelich, Councilman Kevin Rourke and Councilwoman Marcy DeGiulio-Galka. Also present City Attorney Kenneth Kruse, City Administrator Kevin Welch, City Engineer John Kozuh and Deputy Elections Clerk Courtney Nicholls

Resolved, to approve the agenda, as amended, for December 23, 2003.

MOTION ADOPTED

A presentation, by Councilman Kevin Rourke, of a Proclamation from the City of Allen Park to Cabrini High School Girls Basketball Team for the distinction of being crowned the 2003 A-West Catholic League Champs, District and Regional Champs and State semi-finalist.

A presentation, by the Allen Park Fire & Police Commission of Public Safety (Mr. Gary Dell, Mr. Dale Lewis and Mr. Curtis McGuire Jr.), of the "McKeever Award" to Police Sergeant Susan Pitts, Police Lieutenant Dean Tamsen, Fire Lieutenant Peter Zammit and Fire Captain Charles Kupovits.

City Clerk requested a correction to the minutes of December 9, 2003, showing Marcy DeGiulio-Galka and Eric Waidelich as Representatives not Chairpersons on the Allen Park/Melvindale Advisory Committee for the 24th District Court.

City Administrator, Kevin Welch, commended Finance Department, Ellen Templin and Anthony Rinna, for all their hard work and assistance given to Darnell & Meyering to enable audit to be completed.

Resolved, to accept, with regrets, the resignation of Bishop Francis Reiss as member of the Board of Ethics as of November 6, 2003.

Resolved, to have a Workshop for all Elected Officials and Key Department Heads, at City Hall, on Friday, January 23, 2004 and Saturday, January 24, 2004. The Workshop is open to the public, but not open to public participation. The Workshop agenda; Identify problems and establish a vision.

Resolved, that the Mayor and Council have a Work Session, open to the public but not open to public participation, on Tuesday, January 6, 2004, at 7:00pm, to review the DDA Middle Allen Road Project.

Resolved, that the City Council hereby appoints Kristine Barann to the position of Finance Director as of January 12, 2004 at a salary of $65,000 for the period of January 12, 2004 through November 30, 2004 and that said salary increase for the period of December 1, 2004 through November 30, 2005 at the rate ranges equivalent to the General Employees contract for FY04/05,

Be It Further Resolved, that Kristine Barann shall receive as a minimum those benefits listed in the Appointee Compensation Package, or the greater of those benefits contained by the AFSCME contract, except as to a city vehicle,

Be It Further Resolved, that Kristine Barann shall be allowed to use a pool car for transportation on city business.

Resolved, that the Common Council name Anthony Rinna as Interim City Administrator as of January 5, 2003 for a period of (6) months or until a new City Administrator is named, which ever occurs first, at an annual salary of $85,000 with a continued appointed official benefit package; and allow Mr. Rinna to be considered for the new City Administrator’s position; and that the Common Council authorize the Mayor to seek an applicant for City Administrator at a salary range of $90,000 to $100,000 DOQ with other benefits listed in compensation package and using current job description as a guide.

Resolved, to amend existing resolution to read; that Mr. Anthony O. Rinna be appointed to the position of City Administrator effective January 5, 2004 for the period of January 5, 2004 to November 30, 2005; and further, that his compensation be set at $85,000 for period January 5, 2004 to November 30, 2004, and his compensation for period December 1, 2004 to November 30, 2005 will be determined by the City Council; and further that he will be entitled to the same benefits as AFSCME or the Appointee benefits, whichever is greater.

Resolved, that a Work Session be held with Mayor and Council on Monday, January 5, 2004, at 7:00pm in City Hall, for the purpose of discussing Sanitary Sewer Issues with City Engineer John Kozuh. Work Session is open to the public, but not open to public participation.

Resolved, that the economic and non-economic benefits for foreman for July 1, 2002 through June 30, 2005 be approved as follows:

Duration 7/01/2002 through 6/30/2005

Same benefits as approved by City Council on 1/25/2000.

All relevant economic changes as approved by AFSCME for 2002 – 2005.

All changes to insurance programs as approved by AFSCME effective 2002 – 2005.

DROP program as follows:

Same as COAM plan as it relates to the Foreman, with the following exceptions:

Unused accumulated leave time will not be paid until the time when the employee terminates his/her employment with the City, Specifically, at the end of the DROP period.

DROP will be limited to 18 months.

DROP must be selected within the month of July 2004.

Resolved, that Payment # 7 to McCarthy & Smith be approved for payment in the amount of $376,435.72 as recommended by the City Architect, City Administrator and David Boomer (Project Manager). Funds will be taken from account 403-000-985

Presentation, by Councilman Burtka, of a Certificate of Appreciation to City Administrator Kevin Welch for his long career with the City of Allen Park beginning in 1976 to January 4, 2004. Best wishes and continued success and happiness are extended to Kevin from the City of Allen Park

Resolved, that Fire Inspector Gregory Murphy attend the 2004 Winter Michigan Fire Inspectors Society training seminar in Lansing, MI, from February 17-18, 2004. Funds in the amount of approximately $295 will be allotted from account #101-340-960.

Resolved, that Fire Inspector Gregory Murphy attend the 14th Annual Juvenile Arson Conference in Midland, MI from February 25-27, 2004. Funds in the amount of $355 will be allotted from account #101-340-960.

Resolved, that a request for a pay increase to $10.00 per hour (with no benefits), to take effective December 15, 2003, for part-time employee Ms. Penny Regula, by Police Chief Kenneth Dobson be tabled and directed to City Administrator Anthony Rinna.

Resolved,

Whereas the City of Allen Park recognizes the quarantine of trees in a six-county area in Michigan infested with the Emerald Ash Borer Disease; and

Whereas Allen Park is contained within that six-county area: and

Whereas this body recognizes that residents have lost over 800 ash trees in the easements to the disease and the city, overall, has lost upwards of 1000 ash trees to Emerald Ash Borer; and

Whereas the citizens of Allen Park support improved air quality, reduced soil erosion, improved water condition and increased oxygen gained from trees.

Now, Therefore Be It Resolved that the City of Allen Park enthusiastically endorses and supports the DTE/Michigan Department of Natural Resources application for grant monies to replant trees lost to Emerald Ash Borer Disease.
